Daily Broadside | Don’t Tell Me The 2020 Election Was As Pure As The Driven Snow

Just going to leave this right here.

BREAKING: Arizona GOP Files BOMBSHELL Lawsuit Against Corrupt Secretary of State After Discovering from 500,000 to 1.3 Million ILLEGAL Voters on State’s Voter Rolls

The Arizona Republican Party filed a lawsuit against the corrupt Secretary of State Adrian Fontes after discovering from 500,000 to 1.3 million ILLEGAL VOTERS on the state’s voter rolls.

George Behizy reported:

BREAKING: The Arizona Republican party has filed a BOMBSHELL lawsuit against the Secretary of State for violations of the National Voter Registration Act after discovering between 500,000 to 1.3 Million ILLEGAL voters on the voter rolls, including dead people & nonresidents

“The lawsuit highlights outrageous voter registration rates, with some counties exceeding 100% of eligible voters. The lawsuit uncovered that Arizona has between 500,000 to 1,270,000 unaccounted-for voters on the rolls, including deceased individuals and those who have moved away.”

“Our findings reveal a staggering number of counties with more registered voters than eligible citizens, this is a clear indication of a system in disarray. We are holding Adrian Fontes accountable to ensure fair and credible elections in Arizona.”

This exactly how Democrats cheat, bloated voter rolls combined with universal mail in ballots. Republicans have to get ahead of this before November 5th.

Daily Broadside | It’s Not Just Me; Smarter Writers Are Now Declaring the Democrat Party Illegitimate

The Democrat Party is a radicalized, anti-American, Marxist organization that should be abolished, just like the Nazi Party after 1945. I’m not kidding and I’ve said so recently here and in some of my ramblings on X.

But now I’m pleased to hear political commentators who are much smarter than I am saying the same thing. John Hinderaker over at PowerLine blog wrote a short post the day after Trump’s trumped up kangaroo court convictions.

For the second time in their ignoble history, the Democrats have fired on Fort Sumter. Now the question is, what are we going to do about it?

I wrote my initial thoughts on the Trump verdict yesterday afternoon. I want to add to them here.

If Joe Biden is re-elected following this outrage, he will be an illegitimate president. What does that mean? It means, I think, that no one should be obliged to follow his executive orders. All such orders will be illegitimate and should be disregarded, as appropriate. Likewise, residents of the sane states, and their public officials, should be free to disregard rules and orders that come out of the Biden administration’s agencies–the Biden EPA, and so on. And rulings of Biden-appointed judges, or of panels on which one or more Biden judges were part of the majority, should not be given any precedential effect.

We have no duty to conform. In fact, it is our duty to not just resist, but to actively reject any cooperation with Democrats.

More fundamentally, the Democratic Party is now illegitimate. We should stop treating it as a normal political organization. We conservatives have played by the rules, trying to hold our country together in the face of increasingly radical and irrational conduct from our political foes. Those days should be gone. The Democratic Party is now exposed as the enemy of freedom, democracy and the rule of law, and should be treated accordingly.

Correct. And to “treat it accordingly” is to abolish it, make it illegal to reconstitute, and to politically exile its members.

I’m done with trying to reason with Democrats. I’ll talk all day about their need for Jesus, but when it comes to politics, I have no choice but to treat them like the political enemies they are. Anyone who calls themselves a Democrat, is registered as a Democrat, and votes for Democrats, is a threat to you, your family, your freedoms and your conscience.

Conservatives have been patient, have endured much abuse from those in roles of political power, and have hoped against hope that the lawfare and general acts of anarchy would be a short spasm that we could all get through. But like our international enemies, the Left sees negotiation, reasonable dialogue, and a lack of hitting back as weakness, which further encourages them to take more ground and become more inflexible.

It’s time to sever any political relationships with the Left. They don’t want it. They want to destroy the Right, no matter how close to the center you are. Conservatives, traditional Americans, Christians and like-minded allies must fully oppose Democrats at every turn. We need to make them pay for their intransigence by voting them out of office, refusing to cooperate with their laws, and actively make them feel the pain of separation.

Via Buck Throckmorton at Ace of Spades comes this helpful piece by Jeffrey Carter:

Trump should retreat to Florida.

Every single Republican should say that if NY wants to extradite Trump from their state to NY to serve jail time, they will fight the extradition. Trump can freely roam and campaign in their states. If there are fair-minded Democratic governors they could join. But, if they don’t, we know where they stand.

They are on the side of fascism because that is exactly what this is.

You might not like Trump. You might not agree with Trump. For you, this is a John Adams moment. The second president of the United States was no pal of Britain. He abhorred the idea of British troops in Boston, MA. Yet, when push came to shove he defended British troops who were accused by a mob of committing crimes they didn’t commit.

Resist and refuse to cooperate.

  • Let Trump roam free as a bird in Republican governed state. Fight any and all extradition including the use of the police force and any military that the governor controls.
  • Republican Attorney Generals need to engage in lawfare against any and all Democrat officials, including officials in their states. If you are a Republican Attorney General, and you have a Democratic Secretary of State, find something, anything to charge them with. I hate tit for tat, but tit for tat in this case is a lot better than shots being fired.
  • In heavily Republican-dominated states, make life very difficult for Democrats. Do everything you can within the rules of your state to hinder every single idea, statement, or initiative Democrats have. If you can do things without committee hearings, go for it. Shut them out. Democrats actively do it to Republicans. Hence, in Ohio, defy Governor Mike DeWine’s move to put Biden on the ballot. Leave him off the ballot in Ohio. Before this ruling, I was in favor of DeWine’s move.
  • Donate some extra dollars if you can after Joe Biden’s inflation to Trump and any national legislative race. Flip your legislature to Republicans if you can. Democrats are now the party of Fascism. They make no bones about it.
  • It is time for civil, and I stress the word civil, disobedience. That can be painful. But, it’s time to flout politically motivated Democratic rules. March peacefully in the streets. Ignore rules. Don’t pay fees if you can. We know now that Covid was an engineered crisis that was designed to get rid of Trump, not for public health. It’s time to fight all that stuff.
  • When they march in the streets, meet them. March against them.
  • If you are a contractor, maybe pick and choose who you work for. If you show up to a house and a Hamas flag is in front or a BLM sign is in the yard, maybe go to the next job and have them go down the list. Work on out-of-the-closet Republican homes or non-outwardly political homes first. Make them suffer.
  • At your establishment, put up a bumper sticker or flag. It doesn’t have to say “Trump” but it might say “Don’t Tread on Me” or something like that. Let people know. The Silent Majority cannot stay in the closet anymore. It’s hilarious that when I walk down my street, I know if an American flag flies out in front of the house I know they are conservative.

As I’ve written before (here, here, here, and here) it’s often difficult to give advice on what to do about the state of affairs we find ourselves in. Above is a list of simple things most of us can do to register our anger at those who are destroying our country.

It’s now or never.

Daily Broadside | Tony “The Science” Fauci Makes A Killing Killing Millions And Doesn’t Want You To Know About It

This compromised murderer needs to spend the rest of his life in prison for his crimes.

New data from the National Institutes of Health reveals the agency and its scientists collected $710 million in royalties during the pandemic, from late 2021 through 2023. These are payments made by private companies, like pharmaceuticals, to license medical innovations from government scientists.

Almost all that cash — $690 million — went to the National Institute of Allergy and Infectious Disease (NIAID), the subagency led by Dr. Anthony Fauci, and 260 of its scientists.

Don’t believe your lyin’ eyes. Just trust the ScIEnCe embodied in the highest-paid, now retired, government bureaucrat, Dr. Anthony Fauci.

Information about this vast private royalty complex is tightly held by NIH. My organization, OpenTheBooks.com, was forced to sue to uncover the royalties paid from September 2009 to October 2021, which amounted to $325 million over 56,000 transactions.

We had to sue a second time, with Judicial Watch as our counsel, to pry open this new release.

Payments skyrocketed during the pandemic era: those years saw more than double the amount of cash flow to NIH from the private sector, compared to the prior twelve combined. All told, it’s $1.036 billion.

It’s unclear if any of the Covid vaccine royalties from Pfizer and Moderna, the latter of which settled with NIH by agreeing to pay $400 million, is even included in these new numbers. NIH isn’t saying.

There’s no grift here! I refuse to believe it!

The American people have one last crack at getting some candor from Fauci, the face of our COVID response, when he testifies Monday before the House Select Subcommittee on the Coronavirus Pandemic.

Our feckless GOP will get to the bottom of it all, no doubt.

Now he’ll also need to account for bombshell emails sent by one of his deputies, which described in-house strategies to circumvent the federal Freedom of Information Act.

Fauci won’t be able to misspell words to evade scrutiny or have folks physically courier messages — just two of the FOIA-avoiding actions described by Dr. David Morens, a key Fauci deputy.

You know what they did? They used personal email accounts, replaced letters in the text of subject lines so it wouldn’t appear in FOIA searches, and deleted emails they didn’t want found.

From another NY Post editorial:

A 35-page memo by a House subcommittee majority staff directly accuses Fauci himself of taking part in “in a conspiracy amongst the highest levels” of the agency to “hide” and potentially “destroy official records regarding the origins of COVID-19.”

What were Fauci & Co. trying to hide?

Obviously, that NIH had provided grant money used for highly dangerous lab work, which involves making viruses more contagious to humans to help develop vaccines in advance.

Meaning US taxpayers unwittingly helped pay for the kind of research believed to have led to the germ that killed more than 7 million people across the globe.

It also shut down economies, costing the world trillions; led to school closures that set back educational progress; and took a toll on mental and physical health in fundamental ways not yet fully understood or recognized.

Fauci, his NIH boss Francis Collins and their pals at EcoHealth, which was behind the research, were desperate to keep that secret.

Fauci, Collins and the rest of them have forgotten that they work for us. They are insulated from “We the People” and think they’re above the law. Fauci helped fund the Covid virus research illegally, tried to hide it, benefitted from it financially and killed millions of people around the world while he did so.

He needs to spend the rest of his life in prison.

Daily Broadside | Democrats Have Gone Full Communist with Trump Verdict

They finally “got” Trump.

The Democrats and their enablers in the White House and the media crossed a rubicon yesterday and it can’t be undone. If you were looking for proof that we’re a broken republic, you needn’t look any further.

I’m not a lawyer and I don’t play one on TV, so I’ve been hesitant to comment on the Trump trials. But you don’t have to be a legal eagle to see that the guilty verdict handed down yesterday is the stuff of third-world banana republics.

I am angry.

The Democrats have ruined this country and seized on lawfare as their weapon of choice and executed it against Trump with bogus charges, a corrupt Soros DA, a corrupt judge, and a jury that came from a pool in a district that is 90 percent Democrat.

This cannot stand.

None of us are safe now. I don’t care if you’re Democrat, Republican, Independent, Libertarian or Green. If they can prosecute a former president of the United States on such thin, non-existant gruel, they can certainly do it to you.

And they will.

We need to pray for God’s mercy and intervention. Conservatives and other like-minded Americans have patiently watched and waited as the Left unleashed their lawfare against Trump, their lawfare against normal Americans through the Summer of Love riots, the Covid lockdowns, and the stolen election.

That patience is wearing thin. We still have the ballot come November, but no one believes that the election will be untainted by fraud. In fact, we expect that the Democrats will use every means possible, including illegal ballots, to overturn the will of the people.

My vote for Trump is a foregone conclusion. It’s locked in and I will crawl over broken glass on hot pavement to vote for him. It’s no longer about the man himself, whether I like his personality or his policies.

It’s now about the evil of the State and my vote for Trump is a protest against it.

We are in deep weeds, my friends.

If you can, have a good weekend.

Daily Broadside | Robert DeNiro Barely More Cogent Than Biden During NYC Rant

For most of my life I never paid much attention to actor Robert De Niro. As an actor, he belongs in the ranks of top-tier performers like Al Paccino, Jack Nicholson, Denzel Washington, Tommy Lee Jones and Gary Oldman.

But Robert De Niro lost his mind when Trump was elected and still hasn’t recovered. It’s always puzzled me. If one wanted a case study of TDS, rage junkie De Niro is it.

Following Biden’s embrace of one-hit wonder Mark Hamill four weeks ago, his campaign arranges a “press conference” featuring De Niro outside the court where Trump’s trial is taking place.

And he shows up with a mask. A mask!

That’s so 2020.

So what drives De Niro’s contempt for Trump? He’s short on specifics but long on speculation.

De Niro, 80, has already narrated ads for the Biden campaign, and told reporters Tuesday that Trump “wants to sow total chaos” and “destroy not only the city” before expanding his argument to say “eventually he could destroy the whole world.”

“I don’t mean to scare you. No, wait, maybe I do mean to scare you,” he said at one point. “If Trump returns to the White House, you can kiss these freedoms goodbye that we all take for granted.

“And elections. Forget about it. That’s over. That’s done. If he gets in. I can tell you right now. He will never leave. He will never leave. You know that. He will never leave.”

Trump will sow total chaos, destroy the city, destroy the country, destroy the whole world, take away our freedoms, and will never leave.

Sowing total chaos? Like admitting tens of millions of foreigners into the country illegally? Like confusing children about their “gender”? Like letting thieves and homicidal maniacs back on the streets with no cash bail after they commit crime?

Destroy the city? Like Democrat governors did in New York, Los Angeles, Detroit and Chicago? Or like in East Palestine, Ohio, where a train derailment resulted in a toxic chemical spill that Biden could care less about?

Destroy the country? Like destroying businesses during Covid? Like shutting down coal? Shutting down the Keystone pipeline?

Destroy the world? Like in Ukraine, Afghanistan and Israel?

Take away our freedoms? Like censoring topics on Twitter/X? Like putting hundreds of patriots in jail indefinitely without due process over nothing more than walking through the Capitol when invited in by the Capitol police? Like mandating masks and like Biden telling us he’s losing patience with those of us who refused the “vaccines”?

Never leave? Like when Biden and his gang steal the election later this year?

There’s only two options here: he either believes his hype or he doesn’t, and I’m inclined to think he believes it.

It’s fascinating and infuriating, but not impossible to believe that he’s serious.

It’s delusional. It’s exactly the kind of things that conservatives would say about Biden, but we’ve got evidence to back up our assertions that De Niro and his constituency have to ignore.

When Trump goes after the Deep State and the grifting rulers, that’s “sowing total chaos.” That’s upsetting the elites like De Niro, who like their place above the “clowns” that he makes room for. Yes, he actually said that.

It’s so weird.

If you have the stomach for it, you can watch the whole thing here:

De Niro’s fragile ego takes a hit when counter-protestors call him “washed up” and a “mook.” I had to look up what a mook was: a foolish, insignificant, or contemptible person. You know, the very thing that De Niro accuses Trump of being.

But he couldn’t take it when it was dished out.

Reality bites when you’re not acting.

Daily Broadside | Memorial Day 2024

Several times each year I intentionally remind myself of my freedoms and that those freedoms have come at a cost. One of those occasions is Memorial Day.

I found the following poem, written by Wallace Stevens, an American modernist poet who published his first book of poetry (Harmonium) in 1923, just over 100 years ago. In it was a poem called “The Death of a Soldier.”

‘The Death of a Soldier’

Life contracts and death is expected,
As in a season of autumn.
The soldier falls.

He does not become a three-days’ personage,
Imposing his separation,
Calling for pomp.

Death is absolute and without memorial,
As in a season of autumn,
When the wind stops.

When the wind stops and, over the heavens,
The clouds go, nevertheless,
In their direction.

The line that caught me is, “Death is absolute and without memorial.”

Is it true that death is “without memorial”? Perhaps as an event death does its work and offers nothing more. Death itself only takes and provides no memorial.

But as a matter of shared inevitability among us, we recognize that, by nature, there is nothing more here for a person after death, and we make an effort to keep a memory of the deceased alive through our mourning, our cemetaries, and our memorial days.

It is more poignant still when death is voluntarily embraced for a noble cause. Death comes for us all eventually, but some are willing to embrace it unnaturally early for the sake of protecting others they both know and would never know for generations to come.

That’s what this Memorial Day is for. You may not personally know any of the thousands of men and women who have given “the last full measure of devotion.” The many thousands of them probably never knew you. But you can breathe a prayer of thanks for them and their willingness to confront whatever threatened their contemporaries and the lives yet to come, including yours.

Be grateful today for those who made the ultimate sacrifice in service to you and to me.

Daily Broadside | Democrats Taking Out Republican Lawyers Through Lawfare

Welcome back, me!

Have you ever traveled with Amtrak? I have, several times, but will never take the train again. After a disatrous trip earlier this year (iced-over switches, stalled for hours on the tracks as other trains got preference, arrived six hours late), this trip was late, too, and then we got stopped for an hour on the local rails trying to get home.

Better to drive and be in control of the situation than leaving it to someone else. Costs about the same.

So we know that the Deep StateTM is using lawfare against president-in-exile Donald J. Trump, trying to overwhelm him with bogus charges that wouldn’t stand scrutiny in any other situation. They’ve also ganged up on others close to Trump including Michael Flynn, Sidney Powell, and Steve Bannon.

But you know who else they’re ganging up on? Republican lawyers.

Democrats have aggressively targeted over 400 Republican lawyers and politicians with criminal charges, civil lawsuits, and disbarment proceedings ahead of the upcoming presidential election. They have successfully jailed Peter Navarro, with Steve Bannon expected to join him shortly. In multiple states, Democrats have pursued criminal charges against dozens of Republican lawyers and politicians, including:

  • Georgia: 19 Republicans arrested and charged
  • Arizona: 18 Republicans arrested and charged
  • Michigan: 16 Republicans arrested and charged
  • Nevada: 6 Republicans arrested and charged
  • Pennsylvania & Wisconsin: Are still conducting criminal investigations into as many as 30 Republicans who have yet to be charged

In addition to these criminal trials, Democrats are pursuing numerous efforts to have Republican lawyers disbarred. The Soros-backed 65 Project has filed disbarment proceedings against more than 100 Republican lawyers, which prevent many of these lawyers from working until the proceedings are concluded. In almost every case, the charges lack merit, but they have three primary impacts: a chilling effect that discourages other Republican lawyers and politicians from helping Trump, a financial drain on the resources of Republicans who might otherwise use their funds to help elect Trump, and a time drain that physically keeps them busy during the campaign.

If these criminal charges stick because of corrupt judges and DAs, who will be available when we need to challenge the results of the 2024 election, which will undoubtably be just as corrupt as the 2020 election?

Make no mistake, the Democrats are conducting a well-funded, well-organized effort to remove as many Republicans as possible from the November election process. Their goal is to prevent Republicans from ensuring the integrity of the election and protecting the sanctity of your vote. This is a war on the 6th Amendment—everyone, including President Trump and Republican candidates, deserves the right to legal representation. Democrats are working overtime to ensure that doesn’t happen in November.

I encourage you to read the rest of the post at the link. The author lists dozens of lawyers who have been targeted and also features a video of Christina Bobb, a lawyer who is being charged.

We are living in a third-world dictatorship led by the Democrats and their cronies in the Deep State.TM I am more convinced than ever that the Democrat Party should be outlawed, since that is what they are: outlaws.

Daily Broadside | Biden is Everything We Knew He Was And Even the Left Can’t Deny It

One of my favorite political commentators is Victor Davis Hanson (VDH), who writes thoughtful essays underscoring the absurdities and contradictions of the Demojihadis. His latest on X is no exception, where he expertly dissects the miserable fool currently posing as “president.”

Joe Biden’s personal approval rating is at historic lows; almost all his policies do not poll fifty percent. He is behind Trump in almost all the swing states. And now he lies serially even to sympathetic interviewers. In short, finally Biden has been exposed for what he always was and represented.

Senator and Vice President Joe Biden was always sort of a buffoon. He is by nature a grandstander who handsomely profited from his office while posing as good ole Joe from Scranton.

He is a blowhard meddler, one who proverbially has been “wrong on nearly every major foreign policy and national security issue over the past four decades (Robert Gates),” from dissenting on the Bin Laden raid to his trisection of Iraq scheme.

He is a fabulist who believes that the more animated he misleads and slurs (“semi-fascists” “fat”, “lying dog-faced pony soldier”, “chumps”, “dregs of society”, etc), the more likely he is to get away with it. He is a confessed plagiarist. And he has also invented much of his biography, from would be star, college-scholarship athlete and brilliant law student to semi-truck driver and jailed civil rights activist. His uncle, we are instructed, was eaten by cannibals. Joe assures us that he was the first in his family to go to college.

And he is a racist with a repertory of racial taunts and smears unrivaled among modern politicians (“junkie”, “boy”, “you ain’t black”, “the first mainstream African-American who is articulate and bright and clean and a nice-looking guy”, “put y’all back in chains”, the Corn Pop and golden-leg hairs sagas, the “racial jungle” memes, the strange brag about Delaware as a “slave state” (e.g., “You don’t know my state. My state was a slave state. My state is a border state.”), and his encomia for the old Democratic racists of the Senate from former Klansman Robert Byrd (Biden’s self-described “mentor” and “guide”) to segregationist James Eastland (“never called me boy”).

Biden has always had a mean streak that explains why for years he lied about the tragic, fatal auto accident of his first wife and child, using it to libel the truck driver, who was neither drunk nor culpable but smeared publicly for years by Biden as intoxicated and guilty. For years he ignored the pleas of the trucker’s family to please stop libeling an innocent driver.

Got that? Joe Biden is a racist blowhard fabulist meddler and a mean grandstanding lying buffoon.

But we knew that. The Democrats knew that, too.

But that’s not all.

Biden has always put the agendas of his own and his family above the national interest. We witnessed that when he bragged that he fired the Ukrainian prosecutor looking into his son’s Burisma skullduggery. The Biden consortium is corrupt and was enriched with over $25 million through foreign interests’ assurance that Senator and Vice President Joe Biden would deliver on their quid pro quo investments in him.

Any other major politician who habitually invaded the private space of women and preteens to blow on their hair, gobble their necks, squeeze and hug far too long, and be accused of sexual assault would have long since been cancelled by the left.

Add the old disturbing narrative of a naked Vice President Joe Biden exiting his pool in front of female secret service agents, the showering with his pre-teen daughter, the Frank Biden and Hunter naked selfies, and there seems something eerie among the Biden family.

Eerie? How about “sick” or “perverted” or “morally degenerate”?

But we knew that. The Democrats knew that, too.

And now the whole world knows it.

Yet this child-sniffing, money-laundering, grandstanding criminal moron is the person the Democrats foisted on us and who they still insist is the best person to “lead” this nation, even though we know he does nothing but read what his braintrust puts on the teleprompter. Including the word, “pause.”

Biden is the camoflage on the tank, the sheepskin on the wolf, the leaves covering the bear trap.

All he is is a useful idiot.

I don’t trust either party right now, but I have no doubt whatsoever that the Democrats have become the “domestic” enemies that our founders warned us about.

I’ll say it again: the Democrat Party should be outlawed. It’s a mind hive of anti-American ideology and grift. We can’t easily kill the ideology, but we can abolish the political parasite that allows it to flourish.

Daily Broadside | DOJ’s Case Against Trump in Jeopardy Because Jack Smith Doesn’t Have Authority To Charge Him

It’s going to be a short week. I missed yesterday because I wasn’t feeling well, and I’ll be out of town this weekend. But there’s so much material that I’ll be able to at least post some stuff that will make you want to tear your hair out.

Let’s start with the clown show that is all of the persecution by prosecution of Donald J. Trump. Besides all the inflated charges based on a thin-as-gruel layer-of-ice in the Sarhara, including Garland’s DOJ staging photos of the documents that Trump allegedly took illegally, it turns out that the man prosecuting Trump, Special Counsel Jack Smith, is in fact doing so illegally because he has no constitutional authority to do so.

The liberal news media is full of false stories about how Judge Aileen Cannon of the United States District Court for the Southern District of Florida has delayed former President Donald Trump’s trial unnecessarily for allegedly mishandling classified documents. But, in fact, the Biden Administration and its Attorney General, Merrick Garland, are themselves to blame for the current delay. Special Counsel Jack Smith claims to be an inferior officer of the United States, but in fact he holds no such office. Smith is a mere employee of the Department of Justice, and he lacks the power to initiate prosecutions. Lucia v. Securities and Exchange Commission, 585 U.S. __ (2018) holds that only officers of the United States can take actions that affect the life, liberty, and property of citizens.

Judge Cannon has asked for oral argument on June 21, 2024 on former President Donald Trump’s motion to dismiss Special Counsel Jack Smith’s indictment on the ground that Smith was unconstitutionally appointed to his current job because he is not an inferior officer. Washington, D.C. super-lawyer, Gene Schaerr, has filed an amicus brief in United States v. Trump on behalf of former Attorney Generals Edwin Meese III and Michael B. Mukasey, as well as me and Professor Gary Lawson, arguing that Jack Smith was unconstitutionally appointed to be an inferior officer, and Judge Cannon has asked Gene Schaerr to participate in the oral argument, which he has agreed to do.

The Appointment Clause of Article II, Section 2 provides that: “the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.Jack Smith claims to be an inferior officer of the United States appointed by the Head of the Justice Department, but he is instead a mere employee.

It sure seems like Smith is unauthorized to charge “Trump with 40 felony counts, including allegedly violating the Espionage Act, making false statements to investigators and conspiracy to obstruct justice.” If it turns out that the judge agrees, Smith’s case will be dismissed and Garland will have to find someone else with the proper vetting to pursue the case. By that time, the election will be here and, God willing, Trump will have kicked this administration out on its keister.

Jack Smith, however, was a private citizen, and not a sitting U.S. Attorney, when Attorney General Merrick Garland named him to be the Special Counsel who would investigate and prosecute Donald Trump. Smith’s appointment as an inferior officer was thus unconstitutional, and therefore the cases against former President Donald Trump, which Smith is prosecuting in Florida and in Washington D.C. must be dismissed. Again, Congress has never by law vested in the Attorney General the power to appoint inferior officers.

[…]

Thank God Judge Cannon has scheduled oral argument on President Trump’s motion to dismiss Jack Smith’s prosecution of Trump for misuse of classified documents by a Justice Department employee who has not been nominated by the President and confirmed by the Senate. The judge should dismiss Smith’s case, and the Eleventh Circuit, and the U.S. Supreme Court should affirm that dismissal.

Smith should be prosecuted and sued for illegally bringing charges, along with impeaching Merrick Garland.

LOL. That’ll never happen.

Trump did nothing to deserve what he’s getting. This lawless administration is using lawfare to drain Trump’s finances, emotionally destroy him, and keep him off the campaign trail. And it’s doing so illegally.

But Trump seems to thrive in this hostile environment. He comes out swinging and uses the press to his advantage, basically getting in-kind donations with free media coverage that reaches millions and millions of people.

The persecution of Trump in all its forms is a travesty of justice.
