Daily Broadside | The Persecution of Donald J. Trump Hits a Speed Bump

The outrageous lawfare being waged on the former president took a hit this weekend when the New York Supreme Court ordered New York Attorney General Letitia James to remove a letter asking them to disregard Trump’s argument that posting the scandalous nearly half-a-billion dollar bond is a “practical impossibility.”

In the original letter, Ms. James had asked the court not to accept the testimonies of a Trump attorney and broker who detailed the efforts they’d gone through in trying to obtain a $464 million bond, claiming they were unreliable sources. The defense faulted the state for not providing any “reason to doubt any of their assertions,” however, and only making a blanket statement.

“While attempting to cynically and wrongfully tar the Defendants’ witnesses as ‘unreliable,’ the Attorney General does not actually dispute the truth of a single one of their specific claims,” the defense’s letter reads.

The sworn affidavits submitted revealed that the defense had sought out the large bond since before final judgment was entered—raising the fine from $250 million to more than $350 million during the last days of trial—and that negotiations by four brokers with 30-plus surety companies still resulted in no deal. One of the brokers provided additional context, saying a $100 million bond was considered large and a $464 million bond (which includes the ordered interest) is something few sureties have the ability to issue and would issue only for large publicly traded companies.

The attorney general had argued that these affidavits still didn’t provide enough information on why the defendants had been turned down, suggesting that Trump Organization assets aren’t as valuable as the defense claims.

Of course. Of course. There isn’t enough information in the world that would satisfy the legal assassin who boasted that if elected, she would aggressively investigate Trump’s businesses and finances. This is an all-out partisan witch hunt to pump up her ego by providing the Marxist Democrats an in-kind donation with her election interference.

The fact that the court ordered her to withdraw her letter, while not an epic decision, is still a win for Trump’s defense and perhaps indicates James’ overreach and political calculus. The only way to raise the money would be to liquidate his real estate holdings, something that the defense argued was excessive.

President Trump had posted on social media that to divest of his buildings in a “fire sale” would create irreparable damage—he would lose the buildings he was appealing to keep.

“Perhaps worst of all, the Attorney General argues that Defendants should be forced to dispose of iconic, multi-billion-dollar real-estate holdings in a ‘fire sale,’” the defense’s letter reads. They called it ”textbook irreparable injury” to require the defendants to appeal without penalty only after taking such losses.

“It would be completely illogical—and the definition of an unconstitutional Excessive Fine and a Taking—to require Defendants to sell properties at all, and especially in a ‘fire sale,’ in order to be able to appeal the lawless Supreme Court judgment, as that would cause harm that cannot be repaired once the Defendants do win, as is overwhelmingly likely, on appeal,” the defense argued.

In other good news for Trump, a recent Marquette University/CNBC poll shows that Trump has all but demolished Biden on who Americans trust to handle the border.

Look at that advantage that Donald Trump has on immigration and border security. It’s near 30 points. This is a tremendous change that’s going on and it’s no wonder that Donald Trump is running on immigration,” Enten observed, before adding, “Voters at this particular point are quite concerned about immigration, and they trust Donald Trump on this particular issue.”

Even among Hispanics.

“If you ask Hispanic voters, who do they trust more on border security and immigration? Overwhelmingly, they trust Donald Trump more, by a tremendous margin. Look at that: 49% to 24%. And that is in line with what we’re seeing in the polls in general among Hispanics, right?”

Meh. This is the same vibe I got in 2020. The country is fed up with the Marxist anti-Americans, but they hold all the power. I will be shocked if Trump wins come November.

Yesterday brought news of a host of host firings and leavings, the most shocking of which was Tucker Carlson at Fox News.

Tucker Carlson, the provocative, conservative prime-time host who sustained Fox News as a ratings juggernaut, has been forced out of the network.

Fox News announced the stunning departure of its top-rated host Monday with no explanation, but people familiar with the situation who were not authorized to comment publicly said the decision to fire Carlson came straight from Fox Corp. Chairman Rupert Murdoch with input from board members and other Fox Corp. executives.

According to one person familiar with the discussions, Murdoch’s son Lachlan, executive chairman of Fox Corp., and Suzanne Scott, chief executive of Fox News Media, decided late Friday that Carlson had to go.

Carlson’s last show was Friday.

“Fox News Media and Tucker Carlson have agreed to part ways,” the network said in a statement. “We thank him for his service to the network as a host and prior to that as a contributor.”

This follows the exit of Dan Bongino last week and rumors that Maria Bartiromo will go, too.

Seems like Fox is bleeding off whatever remaining conservatives are still at the network. Sure, Hannity is a conservative, but he’s a largely ineffective conservative. He’s not a movement leader. I haven’t watched him in years because he talks too much about himself and is too predictable. He’s a soft and comfortable conservative.

Greg Gutfeld is a weird dude who isn’t all that funny but has parlayed a humorous schtick into a regular show torching liberals. He also burns Geraldo Rivera during The Five, but that doesn’t mean he’s a movement leader.

Tucker Carlson was the only reason I ever tuned into Fox News anymore. He was smart, bold, and insightful. His monologues were often shared and talked about. Now that he’s gone, I can’t think of a single reason to watch. It’ll be interesting to see what happens — it sort of feels like a Bud Light moment. When you alienate your core audience, I’m not sure what they expect will happen.

Over at CNN, Don Lemon — or, as Tucker called him, Don le Mon — was fired after 17 years with the network. A boorish gay news personality, Lemon had tested the patience of new CEO Chris Licht with his antics during his demoted gig as a morning show anchor with two women.

CNN fired longtime host Don Lemon on Monday following his short and disastrous run as a morning show host, a little over two months after he apologized for on-air comments about Republican presidential candidate Nikki Haley being past her prime.

The move quickly turned nasty. While CNN chairman and CEO Chris Licht announced, after Lemon had co-hosted the show Monday, that they had “parted ways,” Lemon characterized it as a firing and said it was surprise to him.

“After 17 years at CNN I would have thought someone in management would have the decency to tell me directly,” Lemon said. CNN said that Lemon was given the opportunity to meet with management but released a statement on Twitter instead.

CNN offered no public explanation for Lemon’s dismissal. During a February discussion on “CNN This Morning” with co-hosts Poppy Harlow and Kaitlan Collins about the ages of politicians, he said that the 51-year-old Haley was not “in her prime.” A woman, he said, was considered in her prime “in her 20s, 30s and maybe her 40s.”

Harlow challenged Lemon, trying to clarify what he was referencing: “I think we need to qualify. Are you talking about prime for childbearing or are you talking about prime for being president?”

“Don’t shoot the messenger, I’m just saying what the facts are,” Lemon responded.

Licht apparently decided that le Mon was past his prime. I never watched CNN, so my viewing habits won’t be affected by his ouster.

I think Licht is trying to pull CNN rightward after its sojourn into Trump Derangement Syndrome on the far left during Trump’s administration. On the other hand, it looks like Rupert Murdoch is pulling Fox News leftward from a more centrist position. It has a reputation for being a “conservative” network, but guys like Bret Baier, Geraldo Rivera, Jessica Tarlov, and former hosts Shepherd Smith, Juan Williams, and Chris Wallace, to varying degrees, aren’t and weren’t true conservatives. In addition, Fox News also has former House Speaker and RINO Paul Ryan on its board, and Lachlan Murdoch, Rupert’s son, is no conservative.

Carlson will be a hot commodity on the open market. Wherever he lands his audience will follow. Fox News will experience a severe drop in its ratings, and whoever picks up Carlson will experience a spike in theirs.

It’s Thursday and while you were minding your business and taking care of your loved ones, the ground beneath your feet continued to move. It may not look a lot different today but, believe me, it’s different than yesterday.

It’s particularly different when it comes to the legacy media and, specifically, when it comes to CNN. I’ve made no secret of my disdain for the legacy media outlets like MSNBCNNDNC+. They’re basically mouth organs for the anti-American Democrat party. Glenn Reynolds and his company of writers over at Instapundit often say things like, “Just think of the media as Democratic Party operatives with bylines, and it all makes sense.”

Except at CNN, you can’t think of them as Democrat party operatives, but as members of the Ministry of Truth in America; more like Pravda, the former official newspaper of the Communist Party of the Soviet Union. It’s no secret that CNN and other left-wing “news” outlets are biased in favor of the Democrats, but it wasn’t until this last week that they actually admitted what they are: a propaganda publishing house.

You may remember we recently covered that: “The term for people who lobby for Democrat policies in this clumsy of a manner is ‘Democrat activists in the propaganda field,’ certainly not reporters, or journalists. They need to be treated as what they are. It’s time to stop acting like these political activists are professionals who do honest journalism” (Mollie Hemingway).

In the latest Project Veritas sting video, CNN Technical Director Charlie Chester admits that CNN uses “propaganda” to help the Democrats.

“Look what we did, we got Trump out. I am 100% going to say it, and I 100% believe that if it wasn’t for CNN, I don’t know that Trump would have got voted out,” Chester says. “I came to CNN because I wanted to be a part of that.” He then admits that CNN made up a story about Trump’s health. “[His] hand was shaking or whatever, I think. We brought in so many medical people to tell a story that was all speculation … we were creating a story there that we didn’t know anything about. That’s what—I think that’s propaganda,” he says—and then shrugs off his admission.

“I think that’s propaganda.”

Yeah, I think that’s propaganda, too. Here’s how Merriam-Webster defines the word propaganda: “the spreading of ideas, information, or rumor for the purpose of helping or injuring an institution, a cause, or a person.” Hmm. Does that fit? CNN says they worked to harm president Donald J. Trump while propping up a “young geriatric” Biden to get Trump out.

Rumor? Check. Helping a cause? Check. Injuring a person? Check.

I think that’s propaganda.

In a second video, Project Veritas revealed the same junior commie talking about how CNN is trying to destroy Rep. Matt Gaetz. Here Chester admits CNN has an agenda and is intentionally trying to hurt Gaetz.

“If the agenda, say, is to like get, like Matt Gaetz right now—he’s like this Republican. He’s a problem for the Democratic Party because he’s so conservative and he can cause a lot of hiccups in the passing of laws and whatnot. So, it would be great for the Democratic Party to get him out. So we’re going to keep running those stories to keep hurting him. and make it so that it can’t be buried, and like just settled outside of court and just like, you know, if we keep pushing that, it’s helping us.”

Rumor? Check. Helping a cause? Check. Injuring a person? Check.

I think that’s propaganda.

When our Founders guaranteed “freedom of the press” in the First Amendment, what they meant was the right to publish apart from government approval. They intended to prohibit “Congress from restricting the press or the rights of individuals to speak freely.” And by “press” they literally meant the printing press.

What they did not mean was “journalism” or “newspapers” or “mainstream media”—and certainly not “CNN.”

The establishment media “press” of today has arrogated to itself a freedom belonging to all Americans and has used that theft to elevate itself to constitutionally protected status. The implications of this error are profound: those preening and self-righteous media elitists have no more rights or privileges under the Constitution than any other citizen and merit no special consideration from any other American, including elected officials. The same crowd which perpetrates fake news on us has perpetuated a fake meme about their own existence. It’s not quite stolen valor, but it’s at least stolen position, authority and reputation.

Here we have a member of the “establishment media press” which now openly admits that it has a viewpoint, an agenda, and a willingness to publish disinformation in pursuit of both. It probably also believes that it has “constitutionally protected status.”

“Look what we did, we got Trump out,” says Charlie Chester. Yeah, look what you did: Millions of illegal aliens crossing the border, kids being separated from parents, sex trafficking, paying $3.00/gal at the pump, and a brainless puppet occupying the White House—all courtesy of CNN!

CNN is an enemy of the people and should be treated like one.

Say, does anybody know if there’s a regulatory body that’s responsible for implementing and enforcing America’s communications law and regulations? A federal commission or agency, perhaps?

Trump was more right than we knew when he called CNN “Fake News.” Even CNN admits as much. Equally pathetic is that CNN has billed itself as “The World’s Most Trusted Name in News.” That’s propaganda if I’ve ever heard it.
