Huge development as Texas AG files a lawsuit against the swing states of Georgia, Michigan, Pennsylvania, and Wisconsin in the U.S. Supreme Court over unconstitutional changes to election laws. Ken Paxton filed the lawsuit on Tuesday, alleging the four states violated state and federal law when they modified election procedures.
SCOTUS will hear the case and eight other states joined the lawsuit the same day: Louisiana, Arkansas, Alabama, Florida, Kentucky, Mississippi, South Carolina, and South Dakota.

In a statement, AG Paxton said (with my emphasis),
Trust in the integrity of our election processes is sacrosanct and binds our citizenry and the States in this Union together. Georgia, Michigan, Pennsylvania and Wisconsin destroyed that trust and compromised the security and integrity of the 2020 election. The states violated statutes enacted by their duly elected legislatures, thereby violating the Constitution. By ignoring both state and federal law, these states have not only tainted the integrity of their own citizens’ vote, but of Texas and every other state that held lawful elections. Their failure to abide by the rule of law casts a dark shadow of doubt over the outcome of the entire election. We now ask that the Supreme Court step in to correct this egregious error.
In a remarkable assertion, the lawsuit also claims that, statistically, it’s not possible for Biden to have won all four states (with my emphasis):
- The probability of former Vice President Biden winning the popular vote in the four Defendant States—Georgia, Michigan, Pennsylvania, and Wisconsin—independently given President Trump’s early lead in those States as of 3 a.m. on November 4, 2020, is less than one in a quadrillion, or 1 in 1,000,000,000,000,000. For former Vice President Biden to win these four States collectively, the odds of that event happening decrease to less than one in a quadrillion to the fourth power (i.e., 1 in 1,000,000,000,000,0004). I have no idea how they made that calculation, but if they were willing to include it in a lawsuit before the Supreme Court, you can be fairly sure that it’s a solid claim. (The qualifier is “fairly sure” because it is 2020, after all.)
It’s heartening to see the fight that these states are bringing. Since I’m not a lawyer, I can’t tell how strong their case is, but common sense tells us that there were enough irregularities in this election to deserve a closer look. In their filing, Texas cited several.
Dozens of witnesses testifying under oath about: the physical blocking and kicking out of Republican poll challengers; thousands of the same ballots run multiple times through tabulators; mysterious late night dumps of thousands of ballots at tabulation centers; illegally backdating thousands of ballots; signature verification procedures ignored; more than 173,000 ballots in the Wayne County, MI center that cannot be tied to a registered voter.
Videos of: poll workers erupting in cheers as poll challengers are removed from vote counting centers; poll watchers being blocked from entering vote counting centers—despite even having a court order to enter; suitcases full of ballots being pulled out from underneath tables after poll watchers were told to leave.
Facts for which no independently verified reasonable explanation yet exists: On October 1, 2020, in Pennsylvania a laptop and several USB drives, used to program Pennsylvania’s Dominion voting machines, were mysteriously stolen from a warehouse in Philadelphia. The laptop and the USB drives were the only items taken, and potentially could be used to alter vote tallies; In Michigan, which also employed the same Dominion voting system, on November 4, 2020, Michigan election officials have admitted that a purported “glitch” caused 6,000 votes for President Trump to be wrongly switched to Democrat Candidate Biden. A flash drive containing tens of thousands of votes was left unattended in the Milwaukee tabulations center in the early morning hours of Nov. 4, 2020, without anyone aware it was not in a proper chain of custody.
I’m flabbergasted that anyone dismisses the alleged fraud as nothing or as a “conspiracy” (and someone I know said exactly that). If this is allowed to stand, it will severely damage our republic. Actually, it has already severely damaged it—it’s now a matter of just how extensive and long lasting that damage will be.
